Rolling Wheels Nepal

These Terms and Conditions constitute a legally binding contract between Rolling Wheels Nepal and the individual or entity renting a vehicle (“Lessee”). By taking possession of a rental vehicle, the Lessee acknowledges that they have read, understood, and agreed to be bound by this Agreement in its entirety.

1.Eligibility and Documentation Requirements

To be eligible to rent a vehicle from Rolling Wheels Nepal, the Lessee must satisfy all of the following requirements at the time of rental:

  • Be at least 18 years of age.
  • Hold a valid, government-issued driver's license appropriate to the category of vehicle being rented.
  • Present one original, government-issued photo identification document (National Citizenship Certificate, Passport, Voter ID, or equivalent).
  • Provide either a signed blank cheque as security instrument, or a cash security deposit with a minimum of NPR 50,000.

All original documents and security instruments will be returned upon successful completion of the vehicle return inspection.

2.Authorized Drivers

Only the Lessee and pre-authorized individuals on file with the Company are permitted to operate the rented vehicle. Additional drivers may be added subject to prior written or electronic notice, submission of a copy of their valid driver's license, and meeting the minimum age requirement of 18 years.

The Lessee remains fully liable for any incidents, damages, or losses that occur while any authorized driver is operating the vehicle.

3.Permitted Use and Geographic Restrictions

  • Operation outside Nepal is strictly prohibited and constitutes a material breach of this Agreement.
  • The vehicle shall not be used for illegal, reckless, or negligent purposes including racing, stunts, or overloading.
  • Sub-renting or commercially hiring out the vehicle to any third party is strictly forbidden.

The Company reserves the right to terminate this Agreement immediately and recover the vehicle if the Lessee is found to have violated the permitted use conditions.

4.GPS Monitoring

All vehicles are equipped with GPS tracking devices. By entering into this Agreement, the Lessee consents to real-time monitoring of the vehicle's location, speed, and movement patterns throughout the rental period. GPS data may be used to verify geographic compliance, assist in vehicle recovery, and investigate incidents.

5.Mileage Policy

5.1 Standard Vehicles (Non-EV)

A mileage allowance of 200 kilometres per day (cumulative across the rental period) is included in the rental rate.

5.2 Electric Vehicles (EV)

For EV rentals, the mileage allowance is 250 kilometres per day on the same cumulative basis.

5.3 Excess Mileage Charges

Any kilometres driven beyond the cumulative allowance will be charged at a rate starting from NPR 20 per kilometre. The exact rate varies by vehicle type and will be communicated at the time of booking.

6.Fuel and Charge Level Policy

6.1 Conventional Fuel Vehicles

The vehicle will be delivered at a documented fuel level. The Lessee must return the vehicle at the same fuel level. Failure to do so results in the Company refuelling at the prevailing market rate, charged to the Lessee.

6.2 Electric Vehicles

For EVs, the vehicle must be returned at the same or higher charge level as at dispatch. A discrepancy charge of NPR 10 per percentage point below the dispatch level will be applied.

Example: Vehicle dispatched at 85% and returned at 60% = 25 percentage point difference = NPR 250 charge.

7.Vehicle Condition Upon Return

  • Cleanliness: Must be returned in reasonably clean condition. A NPR 1,000 washing fee applies if returned unacceptably dirty.
  • Fuel/Charge Level: As specified in Section 6.
  • External Condition: The Lessee is liable for all external physical damage including scratches, dents, broken mirrors, cracked lights, and damaged body panels, regardless of fault.

8.Damage, Mechanical Failure, and Liability

8.1 External and Physical Damage

The Lessee assumes full financial liability for any external or physical damage sustained during the rental period. Damage costs are assessed by the Company's designated mechanic and the Lessee is required to cover full repair or replacement costs.

8.2 Mechanical and Internal Failures

Failures attributable to pre-existing issues or normal wear shall be borne by the Company. Failures arising from the Lessee's negligence, misuse, or failure to act on observable warning signs are the Lessee's full financial responsibility.

8.3 Lessee's Duty of Care During Operation

  • Conduct regular inspections of fluid levels (engine oil, coolant, brake fluid) before and during long journeys.
  • Actively monitor the vehicle's instrument panel for warning indicators or abnormal readings.
  • Take appropriate and prompt action upon observing any warning sign — stop safely, switch off the engine, and contact the Company.

Where a mechanical failure could have been prevented by a reasonable response to observable warning signs (e.g., engine seizure after ignoring an overheating warning), the Lessee shall be fully liable for all repair costs.

8.4 Accident, Theft, and Total Loss

In the event of accident, theft, or total loss, the Lessee bears full financial responsibility for all associated costs, except where covered under the vehicle's third-party insurance (refer to Section 9).

9.Insurance

Rental vehicles are covered by standard third-party insurance as required under Nepal law. This coverage pertains solely to third-party liability and does not cover damage to the rented vehicle itself, theft, or personal injury to the Lessee. The Lessee is advised to arrange any additional coverage independently.

10.Rental Period, Office Hours, and Return Timing

10.1 Rental Basis

All rentals are calculated on a 24-hour basis from the recorded dispatch time.

10.2 Office Hours

Operating hours are 7:00 AM to 7:00 PM, seven days a week. Vehicle handover and return are processed only within these hours.

10.3 Late Return Policy

A grace period of 30 minutes beyond the agreed return time is permitted at no charge. Beyond the grace period:

11.Rental Extension

Extensions are subject to vehicle availability and must be confirmed by the Company. Do not assume an extension is approved until confirmation is received.

12.Early Return and Cancellation Policy

If the Lessee returns the vehicle before the agreed rental end date, the following cancellation charges apply based on the number of unused rental days:

Refunds, where applicable, will be processed after deducting all outstanding charges and the applicable cancellation fee from the total amount paid.

13.Payment Terms

The full rental amount is due in full prior to vehicle handover. Accepted payment methods:

  • Cash (Nepali Rupees)
  • Digital wallets (eSewa, Khalti, and other supported platforms)
  • Bank transfer or online banking
  • Any other payment method mutually agreed upon at the time of booking

All additional charges (late return fees, damage costs, cancellation fees, etc.) are due upon vehicle return or upon notification by the Company, whichever comes earlier. The Company reserves the right to deduct outstanding amounts from the security deposit.

14.Overspeeding and Traffic Compliance

The Lessee must comply with all applicable traffic laws and speed regulations of Nepal at all times. The Company enforces its own speed monitoring policy using the vehicle's GPS system:

  • Upon detection of overspeeding, the Company will issue a first warning via SMS.
  • Continued or repeated overspeeding may result in a penalty of up to NPR 5,000.
  • The Lessee remains solely responsible for any traffic fines or legal consequences during the rental period.

15.Lessee Communication Obligations

The Lessee's registered contact number must remain reachable throughout the rental period. Failure to respond to communication attempts for a continuous period of 48 hours or more may result in a penalty of up to NPR 10,000 and vehicle recovery proceedings.

The Lessee must notify the Company promptly in the event of any accident, breakdown, theft, or other significant incident.

16.Breakdown and Roadside Assistance

  • Within 30 km of the Company's Kusunti office: the Company will attempt to dispatch a replacement vehicle, subject to availability.
  • Beyond 30 km: the Company will coordinate with qualified mechanics nearest to the vehicle's GPS location.

The Lessee must remain in safe proximity to the vehicle and maintain active communication with the Company during the assistance process.

17.Prohibited Conduct

The following actions constitute a breach of this Agreement and may result in immediate termination of the rental, vehicle recovery, forfeiture of the security deposit, and/or legal proceedings:

  • Operating the vehicle outside the borders of Nepal.
  • Allowing an unauthorized driver to operate the vehicle.
  • Operating the vehicle under the influence of alcohol, narcotics, or any impairing substance.
  • Using the vehicle for commercial hire, taxi, or ride-sharing without prior written consent.
  • Tampering with or attempting to disable the GPS tracking device.
  • Misrepresenting information on the rental agreement or providing fraudulent documentation.
  • Abandoning the vehicle without notifying the Company.

18.Governing Law and Dispute Resolution

This Agreement shall be governed by and construed in accordance with the laws of Nepal. Any disputes that cannot be resolved amicably shall be subject to the exclusive jurisdiction of the Lalitpur District Court, Lalitpur, Nepal.

19.Amendments and Updates

Rolling Wheels Nepal reserves the right to amend these Terms and Conditions at any time without prior notice. The version in effect at the time of vehicle handover shall govern the rental in question.

20.Acknowledgement and Acceptance

By accepting the keys to the rented vehicle, the Lessee confirms that:

  • They have read and fully understood these Terms and Conditions.
  • They agree to be legally bound by all provisions of this Agreement.
  • All information provided to the Company is accurate and truthful.
  • They are in a fit and legal condition to operate the vehicle.
